TEMPORARY BUSINESS VISITS

Business Visitors

All visitors to Canada need a travel authorization to enter and remain in the country even when making a very short visit (IRPR 7). As a result, the general expectation is that foreign business visitors submit a written application. This written application is what is known in everyday language as making a visa application. 

The requirement to apply “in writing” may be waived for foreign nationals who are citizens of “visa-exempt” countries. Such visitors may obtain an electronic travel authorization (eTA) before entering Canada. At other times, they may make an oral application to an authorised officer at a Canadian port of entry (PoE). Usually, their application is approved on the spot.

Apart from country of origin, there are also other reasons that result in a visa waiver like the possession of a diplomatic passport or being a member of a sea or air crew.

Nigerians without a secondary passport from a visa-exempt country and visitors coming into Canada from most other African countries fall into the category of persons that need a visa to enter Canada. The purpose of the visit, be it business exploration, vacation, studies or work is usually immaterial. Once you are not from a visa-exempt country, you will need a visa to enter Canada. 

As a result of this, all business executives and senior managers coming into Canada on behalf of their companies or employers need to apply for a temporary residence visa (TRV) if they are not visa-exempt. While making such an application, it is important to fill the required forms accurately. The applicant must also endeavor to identify the purpose of the visit truthfully. Where the intention is to visit for business relations, that should be stated. If the purpose of the visit is purely touristic, that should also be stated. This and all other details in all the applicable immigration forms need to be correctly populated. This is because failure to be honest with Canadian immigration can result in a charge of misrepresentation and a 5-year ban from accessing immigration services with the Government of Canada.

Even when the TRV is issued for business travel, it is crucial to note that the visa is not a work permit and therefore does not allow a business visitor to enter the Canadian labour market and seek employment. WORK PERMITS

As a business person, you can become a permanent resident of Canada by first obtaining a work permit which is a temporary immigration status. The Regulations 204 – 208 make provisions for industry executives and skilled tech professionals to obtain a Canadian work permit in an expedited manner. Work permit applications in this category are considered favourably on the justification that the resources have high human capital factors and that their engagement will bring significant benefit to Canada. 

Significant benefits may be economic, social or cultural. The benefit will be articulated properly in the Labour Market Benefits Plan submitted to the ESDC Canada on behalf of the employer.
